Limitation of Liability & Disclaimer

This page governs the free Contract Reader, the free Sanctions Screening tool, paid Deep Reports, the API, and the Discord bot (collectively, the "Automated Service"). It does not govern human-delivered security audit or retainer engagements, which are governed by a separately signed agreement between NexusTrinityio LLC and the client.

1. No Advisory Relationship

Using the Automated Service does not create any advisory, fiduciary, professional-services, or attorney/accountant/auditor-client-style relationship between you and Nexus Trinity. You are not our client by virtue of using the free tool, purchasing a Deep Report, or subscribing to API access. The Automated Service is a software tool, not a professional opinion issued about your specific situation.

2. What the Automated Service Is and Isn't

• It is: an automated analysis of a smart contract's publicly verified source code, reporting specific, sourced observations — and, separately, a direct-match screening of an address against the U.S. Treasury's published OFAC sanctions list.
• It is not: financial advice, investment advice, legal advice, a security audit, a certification, an endorsement, or a guarantee of any kind regarding the safety, legality, or investment merit of any contract, token, or protocol.
• A report finding no flagged issue in a given category is not a statement that no issue exists — see the AI Governance & Disclosure Policy for how "Present / Absent / Undetermined" observations work and why we don't publish a safety score.
• A Sanctions Screening result of "not sanctioned" is not a certification, a compliance clearance, or a substitute for a full AML/KYC program — it means only that the address did not match the specific published list we checked it against at that moment, not full transaction-graph or cluster risk analysis.

3. Assumption of Risk

Interacting with smart contracts and digital assets carries inherent risk, independent of anything Nexus Trinity does or reports. By using the Automated Service, you acknowledge that:

• You are solely responsible for any decision you make involving a contract, token, or protocol, whether or not you used our Service beforehand.
• The Automated Service is one input, not a substitute for your own due diligence, and not a substitute for a full manual security audit.
• Digital asset transactions are generally irreversible. Nexus Trinity has no ability to recover funds lost through your interaction with any third-party contract, regardless of what our report said or didn't say about it.

4. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AUTOMATED SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE AUTOMATED SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY REPORT IS ACCURATE OR COMPLETE.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(A) NEXUS TRINITY LLC, ITS MEMBERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST DATA, OR LOST OR STOLEN DIGITAL ASSETS, HOWEVER CAUSED, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(B) THIS LIMITATION APPLIES REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

(C) TO THE EXTENT LIABILITY CANNOT BE FULLY EXCLUDED UNDER APPLICABLE LAW, NEXUS TRINITY'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE AUTOMATED SERVICE WILL NOT EXCEED THE GREATER OF (I) THE TOTAL AMOUNT YOU PAID NEXUS TRINITY FOR THE AUTOMATED SERVICE IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (II) ONE HUNDRED US DOLLARS ($100).

(D) THIS CAP APPLIES EVEN IF YOUR CLAIM RELATES TO A LOSS OF DIGITAL ASSETS OF SUBSTANTIALLY GREATER VALUE. THE PRICING OF THE FREE AND PAID TIERS OF THE AUTOMATED SERVICE REFLECTS THIS ALLOCATION OF RISK.

6. No Guarantee Against Third-Party Conduct

Nexus Trinity has no relationship with, and does not control, the developers, operators, or owners of any contract you analyze using the Automated Service. We are not responsible for their conduct, including any malicious or negligent conduct discovered or missed by a report.

7. Jurisdictions That Don't Allow These Limits

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In those jurisdictions, the above limitations apply only to the maximum extent permitted by that jurisdiction's law, and the remaining provisions of this document remain in full force.

8. Relationship to Other Documents

This document is incorporated by reference into the Terms of Service. Where this document and the Terms of Service conflict on liability or warranty terms, this document controls, as the more specific statement on the subject.
